One Dollar Ultra (the "Event") is organized by One Dollar Creative LLC (the "Organizer"). Read this document carefully. By typing your name and signing below you give up legal rights, including the right to sue.
The Event is a "last person standing" running event: participants repeat a course at fixed intervals, for as long as they are able, until only one remains. There is no fixed distance and no fixed finish time. The Event is unsanctioned: it is not permitted, sanctioned, insured or supervised by any governing body, municipality, police or road authority. There are no road closures, no course marshals, no aid stations, no medical staff, no timing officials and no sweep vehicle unless the Organizer expressly announces otherwise.
I understand that "last person standing" events and unsanctioned running events carry extreme risks, including serious injury, permanent disability and death.
Those risks include, without limitation: exhaustion and overexertion; dehydration, heat illness and hypothermia; cardiac events; sleep deprivation and impaired judgement over a long duration; falls and trips on uneven, wet, dark or unmarked ground; collisions with vehicles, bicycles, animals, other participants or the public; weather; and inadequate lighting, hydration, nutrition or equipment. Some of these risks cannot be eliminated regardless of the care taken by anyone.
The Event takes place in public areas, including streets, roads, sidewalks, paths and crossings that are open to and used by motor vehicles, bicycles and pedestrians.
I will be sharing the route with live traffic. Nobody will control or stop traffic for me. I am responsible for obeying all traffic laws, signals and signs, for crossing only when it is safe, for staying visible, and for my own conduct toward drivers, residents and other members of the public.
I take part voluntarily and entirely at my own risk. I am solely responsible for my own safety.
That includes my decision to start, to continue and to stop; my hydration, nutrition, clothing, lighting and equipment; my physical and mental condition throughout; and getting myself home safely. I confirm that I am medically fit to take part, that I have not been advised against strenuous or prolonged exercise by a physician, and that I will withdraw if I become unable to continue safely. I will not rely on the Organizer or anyone else to look after me.
To the fullest extent permitted by law, I release, waive, discharge and agree not to sue One Dollar Creative LLC and its members, managers, employees, contractors, volunteers, sponsors, partners and agents (together, the "Released Parties") from and for any and all claims, demands, losses, liabilities, damages, costs and expenses of any kind, including those for personal injury, death and property damage, arising out of or connected with my participation in or travel to and from the Event, including claims arising from the negligence of the Released Parties.
I will indemnify, defend and hold harmless the Released Parties from any claim, loss or expense (including legal fees) brought by me, on my behalf, or by any third party, arising out of my participation or my conduct at the Event.
If I am injured or unable to give consent, I consent to receiving emergency medical treatment and transport, and I accept responsibility for the cost of that care.
The $24 paid after signing is a deposit toward my entry. It reserves my place at the Event. The Organizer will publish the terms on which the deposit is returned or applied before the Event, and I accept those terms by starting.
The Organizer reserves the right to remove any participant from the Event at any time, before or during the Event, for any reason or no reason, and without notice. If I am removed I will leave the course immediately and I will have no claim against the Released Parties arising from that removal.
I consent to being photographed and filmed at the Event and to the Organizer's use of that material in connection with the Event without payment to me.
If any part of this document is held unenforceable, the rest remains in effect. This document is governed by the laws of the state in which One Dollar Creative LLC is organized. I am at least 18 years old. I have read this document in full, I understand it, and I sign it freely. Typing my name below is my electronic signature and has the same effect as a handwritten one.
Your place is held. Keep an eye on your email for the start time and the course. Come rested, bring your own light, water and food, and remember: you are on open roads and you are responsible for yourself out there.
